We decided setting up the Music Industry Association of Romania with the following status:

 


 

1. NAME, TYPE, DURATION, REGISTRES HEADQUARTER

1.1. Organizational forms: Romanian legal person governed by private non-profit association, incorporated under Ord. 26/2000 as amended and approved by Law no. 246/2005, operating as an association to combat piracy in the Law no.8 / 1996.

1.2. Name: Music Industry Association of Romania, expressed AIMR. AIMR initials will appear in all documents, instruments and association ads.

1.3. Address: Bucharest, Blvd Titulescu no. 88B, Sector 1. The association may establish subsidiaries, branches and agencies in the country or abroad, respecting the legal provisions.

1.4. Duration: association is constituted for an unlimited period.

1.5. The initial patrimony of AIMR is 450 lei.

2. PURPOSE AND SCOPE OF ACTIVITIES

2.1. The association has as its main activity represent the interests of holders of copyrights and related rights in the fight against piracy activities in the field of sound and audiovisual against actions that lead to violations of rights recognized and protected by Copyright Law and rights related.

2.2. AIMR will establish collaboration with public institutions with responsibilities in the protection of copyright and related rights.

2.3. AIMR will have the following objectives:

(S) will provide accreditation in accordance with the Law of copyright and related rights;

(Ii) to protect the rights and interests of producers of phonograms and videograms, AIMR members;

(Iii) to act for and on behalf of copyright holders they represent in all cases of violation of their rights under Law no. 8 / 1996 with subsequent amendments;

(Iv) protect the rights of all producers in Romania of foreign or international organizations whose representatives have signed a similar agreement to that effect with AIMR;

(V) study national and international law;

(Vi) where members represent legislative changes concerning them in the sense of protecting their interests;

(Vii) strategies legal and administrative procedures to increase efficiency in the fight against piracy;

(Viii) integration into international structures working in the field;

(Ix) support training and specialization of technical experts in the field of sound and audiovisual piracy and counterfeiting;

(X) promotional activities designed to support group activities;

(Xi) to organize and support media and communication campaigns for the achievement of business;

(Xii) proceed to conduct market surveys on members' activities in music.

2.4. Association is intended associations of producers, publishers of phonograms and / or image storage media, license holders and recipients of transfers in phonographic industry.

2.5. Association also has as object the analysis, protection and development of cultural interests, professional and moral development of its members as well, and in more general terms, to all those who participate in activities and publishing Phonographic Industry in Romania. To achieve this objective, the Association has the right both in Romania and abroad:

(I) to undertake all activities to take all steps to make all the parties and authorities, or on his behalf or on behalf of its members, thereby contributing to achieving the objects of the Association;

(II) to work amicably or in court to fight any infringements of rights or interests of its members and their profession, for this purpose, the members authorize the association to represent them in court. If counterclaims, the association will support the convictions only if the members were ordered not to defend himself.

2.6. Association will seek integration into international structures working in the field. In this regard:

(I) will seek to acquire a representative in Romania of the International Federation of the Phonographic Industry, briefly "IFPI"

(II,) will enter into reciprocal representation with similar associations, to defend moral and material interests of its members internationally.

2.7. Association will fight with all means against piracy, namely:

(I) in association with other public or private institutions;

(II) through the development and implementation of means of control and / or security products in commerce;

2.8. In the spirit of the text of the law, case law and international practice, the Association will develop a regulation of professional conduct rules on honesty containing both commercial and arbitration procedure which, accepting as such its members are obliged to follow them.

2.9. Association will organize various promotional and protecting the interests of its members.
